Legal Insurrection? Lawyer Says He Can't Access Colorado’s System Without Disavowing Immigration Law

Since they're Marxists, Democrats believe in a whole-of-society transformation, and one of their most weaponized tools is the court system in the United States. And if the accusation made by a Colorado lawyer is true, it appears one Democrat state is literally requiring attorneys to choose between federal law and unemployment or woke ideology and financial stability.

Attorney Ian Speir shared a screenshot on X apparently showing that access to Colorado’s e-filing system is now contingent upon promising "under penalty of perjury" that the attorney will "not use or disclose personal identifying information... obtained from this database for the purpose of investigating for, participating in, cooperating with, or assisting in federal immigration enforcement, including enforcement of civil immigration law." Speir emphasized that he does not practice either immigration law or criminal law, but his civil practice is now at a screeching halt until and unless he agrees to the outrageous demand for mass ideological conformity.

Democrats falsely labeled Jan. 6 an insurrection, but sanctuary policies for illegal aliens are a true political and legal insurrection, and a very dangerous one, that has the potential to rig elections and government permanently in Democrats’ favor. Speir explained, “If I click ‘Decline,’ it kicks me out of the system. I must click ‘Accept’ to access the system and continue representing my civil clients — again, in cases that have absolutely nothing to do with immigration law or policy.” 

Speir added, “I've read SB 25-276 (the law referred to below). It does not regulate me as a private attorney or any of the clients I represent in civil matters. This is outrageous draconian overreach. I have ethical obligations to my clients to represent them competently. My existing cases have running deadlines that I must attend to.” He either has to violate his conscience or fail his clients.

Incidentally, it is illegal to interfere actively with federal immigration enforcement. It is even possible that Colorado's sanctuary policy crosses the lines in some cases to violate 8 U.S. Code § 1373, which states: "Notwithstanding any other provision of Federal, State, or local law, a Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual."

Furthermore, 8 U.S. Code § 1324 makes it a crime for anyone who "conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien." In any case, it is clearly highly problematic that Colorado authorities are basically ensuring that no attorney can practice law in the state without agreeing to thwart federal immigration investigations.

This is why Democrats keep winning the culture war, however. They are extremely aggressive in enforcing their ideology, in defiance of the law and without regard to justice. Republicans keep trying to compromise and find middle ground, while Democrats are growing ever more radical and irrational.

It seems a Trump administration investigation into Colorado's e-filing system is in order. The demand for anti-immigration enforcement lockstep apparently violates both federal law and attorneys' constitutional rights.
