Poland forced to recognize first lesbian marriage by administrative EU fiat

For years, a handful of Eastern European nation-states that made the suicidal decision to effectively surrender their sovereignty to Brussels by joining the European Union have been the last holdouts against “gay marriage” in the bloc — and have been made to suffer greatly, economically and politically, for their troubles.

Their resistance was dealt yet another blow recently through a Lublin Provincial Administrative Court, which effectively ruled that European law trumps Polish law where it concerns gay “marriage.”

What happened, in summary, was:

  • A couple of lesbians decided they wanted to get “married.”
  • Couldn’t get “married” in Catholic Poland.
  • Went to Portugal, a fellow EU member state, in 2023 to get “married” instead.
  • Returned to Poland, tried and failed to register “marriage” in contravention of Polish law.
  • Filed a lawsuit against the Polish government to recognize this “marriage” sanctioned by a foreign state.
  • Lawsuit shot down.
  • Took the case to Court of Justice of the European Union (CJEU).
  • CJEU ruled Poland must recognize foreign lesbian “marriage” despite its laws prohibiting it.
  • Provincial Administrative Court in Poland reverses previous Polish court rulings based on CJEU ruling.

The judgment of the Provincial Administrative Court in Lublin is another one that orders a specific Civil Registry Office, this time in Lublin, to transcribe the act marriage same-sex concluded abroad. The court had no doubt that the refusal to enter the marriage of two women into the register was a violation of the constitution, laws and EU treaties. 

In the court's opinion, the contested decision and the decision of the first instance body upholding it were issued with a violation of substantive law affecting the outcome of the case. In the case at hand, the authorities of both instances did not question the legality of the applicants' marriage in Portugal, a Member State of the European Union, and the applicants' submission, together with their application, of the documents necessary for transcription. However, the authorities refused to transcribe the applicants' marriage certificate, stating that the transcription in this case, since it concerns a same-sex marriage certificate, would be contrary to the fundamental principles of the legal order of the Republic of Poland, explained Judge Rapporteur Iwona Tchórzewska. Tuesday verdict is not final.

Alicja and Jola are fighting for the transcription of their marriage certificate, i.e. the recognition in Poland of a union concluded in another country for nearly three years. The women married in Madeira in July 2023 after two years of dating. This was possible because Portugal legalized same-sex marriage in 2010. The wives, as they call themselves, then adopted the common surname Sienkiewicz-Prochowicz…

The women were waiting for a ruling from the Supreme Administrative Court, which was to decide on the transcription of the wedding celebrated by James and Matthew in Berlin. Before the judgment was delivered, he referred a question to the Court of Justice of the European Union for a preliminary ruling….

 In November CJEU ruled that civil registry offices in member states are obliged to recognize same-sex marriages concluded abroad.

“One step closer to equality” reads the inspirational, optimistic chyron on the news report.

Next step: a little institutionalized nip-and-tuck regime on the Polish children’s genitals; those little Slavic bigots have enjoyed intact reproductive organs for far too long.

Brussels will fix them up real good.
